1. Operator and scope

1.1 The website omny.ch (the “Website”) is operated by Omny Digital SA, 1096 Cully, Switzerland (UID: CHE-265.899.979), hereinafter “Omny“. Contact: data@omnyapp.ch.

1.2 These terms govern the use of the Website. By visiting it or using its forms, you accept them. If you do not accept them, please do not use the Website.

1.3 They do not apply to the use of the Omny WiFi service itself. That service is provided to Omny’s clients under a separate master agreement. People who connect to a public WiFi network operated with Omny WiFi are subject to the Public WiFi Terms of Use displayed on the connection portal.

2. Website content

2.1 The Website presents the Omny WiFi service (a captive portal for public WiFi with identification by SMS) and the partner programme. This information is indicative. It does not constitute a binding contractual offer.

2.2 A contract for the Omny WiFi service is concluded only by signing the Omny WiFi master agreement, directly with Omny or through an authorised partner. The prices, features and terms set out in it prevail over the information on the Website.

2.3 The legal information on the Website (in particular on the identification of users of public WiFi and on data protection) is of a general nature. It is not legal advice. Each operator of a public WiFi network remains responsible for complying with its own legal obligations.

3. Request forms

3.1 The “Request a demo” and “Become a partner” forms allow you to contact Omny. Submitting them creates no obligation, either for you or for Omny.

3.2 You warrant that the information you provide is accurate and that you are entitled to submit it. The processing of this data is described in the Privacy Policy.

4. Permitted use

4.1 You use the Website in accordance with applicable law and these terms.

4.2 In particular, it is prohibited to: (a) disrupt the operation or security of the Website, introduce malicious programs or attempt to access non-public areas; (b) use robots, scripts or other automated means to extract the Website’s content in bulk or to submit requests through the forms; (c) submit false, misleading or unlawful information or infringe third-party rights.

4.3 Omny may block access to the Website or disregard requests in the event of use contrary to these terms.

5. Intellectual property

5.1 The content of the Website (texts, graphics, logos, names, layout, code) and the Omny WiFi trademark are protected. All rights belong to Omny or its licensors.

5.2 You may view the Website and print extracts for internal use. Any other reproduction, modification, distribution or exploitation requires Omny’s prior written consent.

6. Availability and accuracy

6.1 Omny endeavours to keep the Website accessible and up to date, but does not guarantee its availability, accuracy or completeness. The Website may be changed, interrupted or withdrawn at any time without notice.

6.2 The Omny WiFi service depends in particular on the UniFi API operated by Ubiquiti Inc., which is controlled neither by Omny nor by the Website. The descriptions on the Website do not guarantee the future availability of the service.

7. Liability

7.1 To the extent permitted by law, Omny excludes all liability for damage arising from the use of the Website or the inability to use it, including indirect or consequential damages and loss of profit.

7.2 This exclusion does not apply in the event of intent or gross negligence (Art. 100 para. 1 of the Swiss Code of Obligations, “CO”), nor where the law imposes liability that cannot be excluded.

7.3 The Website may contain links to third-party websites. Omny has no influence over those websites and is not responsible for them.

8. Data protection

The processing of personal data in connection with the Website is described in the Privacy Policy, which forms part of these terms.

9. Changes

Omny may amend these terms at any time. The version published on the Website at the time of your visit applies. The date of the last update appears at the top of the page.

10. Governing law and jurisdiction

10.1 These terms are governed by Swiss substantive law, excluding the Vienna Convention on the International Sale of Goods.

10.2 The exclusive place of jurisdiction is the registered seat of Omny Digital SA (Cully), subject to mandatory places of jurisdiction provided by law.

10.3 These terms exist in French, German and English. In the event of discrepancy, the French version prevails.
