1. Controller
The controller of the personal data processing described in this policy is:

This policy applies to the website omny.ch (the “Website”). It is based on the Swiss Federal Act on Data Protection (FADP; SR 235.1).
2. What data we process and why
2.1 Technical access data. When you visit the Website, our hosting provider automatically records technical data: IP address, date and time, page requested, data volume, browser type and operating system. This data is used to provide the Website, to ensure its security and proper functioning, and to detect abuse.
2.2 Request forms. If you use the “Request a demo” or “Become a partner” forms, we process the data you enter: first name, last name, email address, phone number, as well as the language of the Website and the type of request. We use it to handle your request, reply to you, prepare any offer or contract, and manage the resulting relationship. The forms contain an invisible anti-spam field that collects no personal data.
2.3 Correspondence. If you write to us by email or call us, we process the data you give us in order to answer your request.
2.4 Cookies. The Website uses only one technical cookie: it remembers the language you chose (“pll_language”). It is necessary for the Website to work. We use no tracking cookies, no audience analytics tools, no advertising and no social media buttons. Only the people who administer the Website additionally receive WordPress login cookies.
2.5 Basis for processing. We process this data to perform or prepare a contract at your request, for our legitimate interests (operating and securing the Website, answering requests, commercial communication with people who contact us) and to comply with our legal obligations.
3. Omny’s other processing
3.1 Users of a WiFi network operated with Omny WiFi. When a person connects to a public WiFi network operated with Omny WiFi, Omny records their mobile phone number, the MAC address and IP address of the device, and the date, time and authorised duration of the connection. No browsing data is recorded. This data is retained for 6 months and then automatically and irrecoverably erased. It is disclosed only to the competent Swiss authorities, on a formal request based on Swiss law. Details are in the Public WiFi Terms of Use displayed on the connection portal.
3.2 Clients and partners. The contact, contract and billing data of our clients and partners is processed to conclude and perform contracts and to comply with our legal obligations (in particular accounting).
4. Recipients
4.1 We do not sell your data and do not use it for advertising.
4.2 We pass it only to our hosting and email provider, Infomaniak Network SA, 1227 Les Acacias (Switzerland), to the extent necessary to operate the Website and our email. It is required to process the data on our instructions and to protect it.
4.3 We may disclose data to Swiss authorities where the law requires it or on a formal request based on Swiss law.
5. Transfers abroad
We process the Website’s data in Switzerland. If, in a particular case, data had to be transferred to a country without an adequate level of protection, we would do so only with the safeguards provided by the FADP (in particular standard contractual clauses) or in the exceptional cases provided by law.
6. Retention
6.1 Technical access data is retained for a limited period set by our hosting provider and then erased.
6.2 Form and correspondence data is retained for as long as necessary to handle your request and, if a contract follows, for the duration of the contractual relationship. If your request is not followed up, it is erased no later than 12 months after the last contact.
6.3 Contract and billing data is retained for the statutory periods (in principle 10 years).
7. Security
We take appropriate technical and organisational measures to protect your data against loss, unauthorised access and misuse, including encryption of communications (HTTPS) and restricted access. However, no transmission over the Internet is completely secure.
8. Your rights
8.1 Under the FADP, you may request access to your personal data, its rectification, its erasure, the restriction of its processing, and the delivery of your data in a common format (portability), and you may object to processing. You may also withdraw any consent you have given at any time.
8.2 To exercise these rights, write to us at data@omnyapp.ch. We may ask you to prove your identity. We reply within 30 days. Some rights may be limited where the law allows, for example where we are required to retain data.
8.3 You may lodge a complaint with the Federal Data Protection and Information Commissioner (FDPIC), www.edoeb.admin.ch.
9. Changes
We may amend this policy at any time. The version published on the Website applies. The date of the last update appears at the top of the page.
10. Languages
This policy exists in French, German and English. In the event of discrepancy, the French version prevails.
